Digital Evidence’ Forensic Audio and Video Evidence Analysis Assists The Cochran Firm with Achieving $1.3 Million Dollar Verdict for Client

Compton, California – March 7, 2008

After 10 days of deliberations, a Compton, California jury awards Winston Hayes $1.3 million dollars in his excessive-force claim against the Los Angeles County Sheriff’s Department.

The case stems from a 2005 incident captured on videotape by professional cameraman, Jesse Escochea, in which Mr. Hayes led sheriff’s deputies on a 12-minute, slow-speed pursuit through a Compton neighborhood. At the conclusion of the low-speed chase deputies discharged approximately 120 rounds from their weapons; compromising the safety of residents, wounding a fellow deputy and wounding Hayes several times during the chaotic crossfire.

Digital Evidence Assists San Diego Law Firm With Successful Mediation in Wrongful Death Case

San Diego, California – August 13, 2007

On August 13, 2007, Digital Evidence Legal Video Services assisted the law offices of Ms. Antoinette Middleton with successful mediation in the wrongful death of 9-year old, Sherry Jackson (not her real name) in San Diego, California.

The youngster was struck and killed by a distracted driver on November 30, 2005 while crossing a street in her neighborhood. “Initially, our litigation support team was contracted to videotape various scenes at the location of the incident.

The Middleton firm’s strategy was to utilize the video during mediation and in the event of trial, present scenes of the incident to the court.

However, upon completing our forensic analysis of the photographic evidence produced by law enforcement officials, and conveying our conclusions to counsel, attorney Middleton enlisted the support of an accident re-constructionist to assist our team with producing a video reenactment of the incident,” Digital Evidence’ CEO, Michael Jones said from his Granada Hills, California office.

Digital Evidence Receives Federal Court Appointment to Conduct Forensic Audio Evidence Analysis in
USA v. Pellicano

Los Angeles, California – August 1, 2006

The United States District Court, Central District of California appointed Digital Evidence Legal Video Services to conduct forensic audio evidence analysis relative to audio evidence recordings in the matter of USA v. Pellicano.

Chief Justice, M. Margaret McKeown signed the order appointing the Southern California firm to the high-profile case on August 1, 2006.

The State Bar of California Certifies Digital Evidence as a Provider of Approved MCLE Credited Activity

On April 27, 2006, The State Bar of California certified the
professionals at Digital Evidence Legal Video Services as a
Provider of Approved MCLE Credited Activity.

The MCLE certification paved the way for Digital Evidence to assist law firms, and other legal professionals with continuing legal education in the areas of litigation support, strategic audio and video evidence applications and admissibility protocols in the high stakes litigation arena.

“That was a great day for our firm,” recalled Digital Evidence’ CEO, Michael L. Jones, upon reflection of the State Bar of California’s decision to certify his firm’s CLE curriculum.

Jones’ firm is Board Certified by The American Guild of Court Videographers. The majority of the legal video firm’s staff consists of former television network news technicians with a reputation for creating exceptional mediation documentaries, recording video depositions, providing tech-support services during witness preparation for video depositions, mock trials and focus groups for their clientele’s analysis. In addition, the “tech-savvy” firm has a very successful forensic audio and video evidence analysis division. Digital Evidence has been appointed by Federal and State Courts to conduct forensic audio and video evidence analysis on high-profile cases in California.

“Over the years our firm has indexed and archived extensive notes relative to questionable tactics employed during video depositions, and other phases of electronic discovery as well; tactics that could have been challenged in court if the opposing counsel was cognizant of the subtle maneuvers. Hence, the advent of our CLE curriculum and MCLE certification status,” Jones explained.

Innocent Man Released From Jail Based On Digital Evidence Legal Video Services’ Forensic Analysis of Video Evidence and Expert Testimony

Long Beach, California, March 1, 2005

After five months of incarceration, a Long Beach, California man wrongly accused of robbing a local convenience store and assaulting the owner was released from jail today.

Robert Taylor (not his real name) is a free man as a direct result of Digital Evidence Legal Video Services’ forensic video analysis and presentation of the evidence to the District Attorney.

“To see the joy on Mr. Taylor’s face, and the faces of his family members upon hearing the Judge announce Mr. Taylor’s release made the time and effort to investigate this incident extremely rewarding,” said Board Certified Legal Video Specialist, Michael Jones, owner of Digital Evidence Legal Video Services.

Additionally, Mr. Jones said he made a rare exception to waive his normal fee for testifying as an expert witness in Mr. Taylor’s case, because the financial hardship placed upon Mr. Taylor’s family was overwhelming. Due to his imprisonment, Mr. Taylor's employment was terminated and he was denied the opportunity to witness the birth of his child, which is a moment in time that he will never recapture. Jones said he could not tolerate knowing an innocent man was incarcerated.

Video Evidence Analysis Made the Difference

“Fortunately, there was video evidence of this incident or Mr. Taylor would probably still be in jail today,” Jones said.

“Upon first glance, one could get the impression that Mr. Taylor was the guilty party, because the clothing worn by the real “bad guy” and Mr. Taylor was similar. However, similarity does not constitute one and the same. Which is why investigations are conducted.

Another fortuitous moment for Mr. Taylor and our firm, was the fact that Board Certified Legal Video Specialist, Ron Beasley, had just completed his assignments and became available to assist with this investigation,” Jones continued.

According to Mr. Jones, “Ron Beasley deserves a great deal of credit for his contributions on this case. Mr. Beasley’s technical expertise was the icing on the cake.”

“I knew we had compelling video evidence to prove Mr. Taylor’s innocence,” Jones elaborated, “but we had some scheduling challenges at the time. Therefore, when Ron became free to render the anatomical comparisons and other distinguishing characteristics necessary to convince the District Attorney of Mr. Taylor’s innocence, our prayers were answered.

The technical enhancements and side-by-side comparisons of the two men gave us the distinguishing factors we needed to present the compelling video evidence for the law firm contracting us to do the analysis and courtroom presentation.

We are fortunate to have Mr. Ron Beasley on our team. His contributions made Mr. Taylor’s attorney’s and my job of presenting the video evidence to the District Attorney seamless. We did not have to waste the court’s time, and I am confident the Judge appreciated that,” Jones said from his Woodland Hills, California office.
